5.7 Possession of Weapons on Campus

I. Application
This policy applies to all persons who are enrolled, employed by, visiting, or providing services to Delaware County Community College (College).
This policy applies equally to those persons that have a government issued license to carry a concealed firearm.
II. Purpose
Delaware County Community College is a Community College organized and operating under the Public School Code of 1949, as amended, of the Commonwealth of Pennsylvania with all requisite power and authority to own its properties and conduct its business. The College is an agency of the Commonwealth of Pennsylvania. The President and the Board of Trustees of the College are responsible to provide a safe and secure educational environment. Accordingly, the College adopts the following policy and procedure addressing the possession of deadly or offensive weapons.
III. Policy
The possession or carrying of any deadly or offensive weapon by any person is prohibited in College academic buildings, administrative buildings, or while attending a sporting, civic, entertainment, recreational, or educational event on the College property. Entry upon College property in violation of this prohibition is expressly forbidden and will result in the individual being directed to remove the weapon immediately from College property. Failure to comply with such directive revokes any license or privilege the individual may have had to be on College property, may result in contacting the local police, and may result in further disciplinary action for students or employees.
Deadly or offensive weapons are defined as any device whose design and/or implementation may produce death or serious bodily injury. For purposes of this policy, deadly and offensive weapons include, but are not limited to, firearms and offensive weapons as defined below:
- Offensive weapons - Offensive weapons include any devices so defined under the Pennsylvania Crimes Code entitled "Prohibitive Offensive Weapons" 1 8 Pa.C.S.A. § 908 (c).
- Firearm - A firearm is any weapon, which is designed to or may readily be converted to expel any projectile by the action of an explosive or the frame or receiver of any such weapon.
IV. Authorized Exceptions
- Certified and sworn municipal, state, or federal police officers who carry proper identification and are on duty are exempt from this policy.
- Students of the College Police Academy when required by its program.
V. Notification of Use of Replica or Prop Weapons
Due to the risk of being identified as a real weapon, any item which looks like a weapon and is used for any purpose on College property must be reported to and approved in writing by the Safety and Security Department prior to use in any activity. It shall be the responsibility of the faculty member or other employee coordinating such activities to secure written approval from the Director, Safety and Security before conducting the activity. All replica weapons brought to campus for the approved activity must be stored in a manner approved by the Director, Safety and Security.
